Fan Connection – Terms & Conditions

These Terms & Conditions (“Terms”) are a legally binding agreement between you and Fan Connection (“Fan Connection,” “we,” “us,” or “our”). By accessing or using the Fan Connection application, website, and related services (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not access or use the Services.

1) General Payment; Platform Fee; Taxes

• All monetary transactions facilitated by the Services are processed by our third‑party payments provider(s). • For all Auctions/Merch, Live Sessions, and Personalized Videos, a platform fee equal to twelve and one‑half percent (12.5%) of the gross transaction amount is charged in addition to any amounts owed to athletes, sellers, or other payees. • By initiating any transaction, you authorize Fan Connection to place a payment hold on your payment method in the full amount due, including the 12.5% platform fee, taxes, and shipping. The hold is placed when the seller accepts your bid. The hold is captured (funds collected) only when the carrier scans the shipment into transit. If the seller does not ship within the hold period, the hold is automatically released and you are never charged. • You are solely responsible for any and all taxes, duties, import fees, and governmental charges arising from your use of the Services.

2) Strict No‑Refund Policy

Except as expressly required by applicable law, all transactions made through the Services are final and non‑refundable. This strict no‑refund policy applies—without limitation—to Auctions/Merch, Live Sessions, and Personalized Videos. Discretionary refunds, if any, may be issued solely by Fan Connection in extraordinary circumstances; we have no obligation to issue such refunds. Nothing in these Terms alters your statutory rights where they cannot be waived.

3) Auctions / Merch (Expanded)

a) Bids and Binding Purchases. • Placing a bid is a binding offer to purchase. If you are the winning bidder, you are obligated to complete the purchase under these Terms. • We may cancel or void a sale if we suspect fraud, abuse, or violation of these Terms.

b) Payment Authorization and Capture. • When you bid or commit to purchase, you authorize a payment hold for the full amount due (hammer price or Buy Now price + 12.5% platform fee + applicable taxes and shipping, if any). • The hold is placed on your card when the seller accepts your bid. Your card is charged (hold captured) only when the carrier scans the shipment into transit. If the seller does not ship within the hold window (approximately 7 days), the hold is automatically released and you are never charged.

c) Shipment; Exclusive UPS Carrier; Risk of Loss. • Due to the high value and rarity of items, shipping is conducted exclusively via UPS. • Sellers must provide a valid UPS tracking number within the timeframe stated in the listing (or, if none is stated, within a commercially reasonable period). • Risk of loss transfers to the buyer when UPS accepts the parcel into its network, unless contrary to non‑waivable law in your jurisdiction. • You are responsible for ensuring the accuracy of your delivery address and for promptly retrieving delivered parcels.

d) Capture on Shipment. • Your payment hold is captured after we receive verification that the item has been handed to UPS and scanned into transit. • If the seller fails to ship within the hold period, the hold is released automatically — no charge, no refund needed. • By participating in Auctions/Merch, you consent to this hold‑then‑capture process.

e) Condition; Authenticity; Representations. • Unless the listing expressly states otherwise, items are sold “as‑is” without warranties of any kind. Descriptions and photos are provided by the seller and may reflect subjective opinions. • Fan Connection does not authenticate, grade, or appraise items and does not guarantee any athlete‑provided description or provenance. Conduct your own due diligence before bidding.

f) Failure to Ship; Lost or Damaged Shipments. • If a seller fails to ship within a reasonable period or provides invalid tracking, contact us at support@thefanconnectionapp.com for assistance. • Claims for loss or damage in transit must be made promptly and may be subject to UPS terms and processes. The no‑refund policy applies unless required by law; remedies may be limited to carrier claims.

g) No Refunds. • All Auctions/Merch sales are final and non‑refundable, including (without limitation) buyer’s remorse, size/fit issues, or preference changes.

4) Live Sessions (Expanded)

a) Scheduling; Access; Preparation. • Live Sessions include livestreams and video calls hosted by athletes at a scheduled time. Please join on time. • You are responsible for your hardware, software, permissions, and internet connection. We recommend testing your setup in advance.

b) Payment Authorization and Capture. • When booking, you authorize a payment hold for the full amount due (session price + 12.5% platform fee + applicable taxes). • Your card will be charged only when the athlete joins the session. If the athlete never joins, we may release or void the hold.

c) Rescheduling; Delays; No‑Shows. • Athletes may be delayed briefly; please allow a reasonable grace period. Rescheduling may be offered at the athlete’s discretion and subject to availability. • If you miss the session or cannot participate due to your device/connectivity issues, the no‑refund policy remains in effect.

d) Conduct; Recording; Privacy. • You may not record, reproduce, retransmit, or publicly display any Live Session without prior written consent from Fan Connection and the athlete. • You must comply with our community standards; harassment, hate speech, or illegal requests will result in removal and possible account action.

e) No Refunds. • All Live Session purchases are final and non‑refundable. Missed attendance, dissatisfaction with content, or connectivity issues do not entitle you to a refund, except as required by law.

5) Personalized Videos (Expanded)

a) Requests; Content Standards; Turnaround. • Provide clear, lawful, and respectful instructions. Athletes may refuse requests that are unsafe, unlawful, infringing, promotional, or otherwise objectionable. • Turnaround times are estimates only and may vary by athlete availability.

b) Payment Authorization and Capture. • When you submit a request, you authorize a payment hold for the full amount (athlete’s price + 12.5% platform fee + applicable taxes). • Your card is charged when the athlete completes and sends the video through the Services. If no video is delivered, we may release or void the hold.

c) Rights; License; Usage Limits. • Subject to these Terms, you receive a limited, personal, non‑transferable, non‑exclusive, non‑sublicensable license to view the video for private, non‑commercial use. • You may not repost publicly, resell, edit, monetize, create derivative works from, or use the video for advertising, endorsements, or promotions without express prior written consent from Fan Connection and the athlete.

d) Creative Discretion; No Refunds. • Athletes retain creative discretion regarding delivery, tone, format, and length (unless a listing specifies strict parameters). • All sales are final and non‑refundable once the athlete has sent the video, including dissatisfaction with style, length, or performance, except where required by law.

6) Disclaimers; Limitation of Liability

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAN CONNECTION DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, FAN CONNECTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice as required by law. Your continued access to or use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms.
